The Russian gay community debates an unprecedently light punishment for the carnage that was committed by a citizen of Krasnoyarsk against his boss who had been allegedly molesting him and forcing to break with wife for a long time. The sentence was a spit on LGBT citizens who for the last months are surviving despite the storm of defamation unveiled by the Russian authorities and politicians who have got loosened due to the acting anti-gay laws.
The court explains its light judgment by "temporary insanity of the accused" who was "under the influence of a long-term psychologically damaging situation", as investigators have found.
"The boss, a married man, many times had been sexually molesting his employee, forcing him for intimacy. The boss knew that his driver had a pregnant girl-friend and they had been living together without being married. Despite of this he was trying to force a young man to break with his future wife and come to live with him together. Many time the victim was calling over the telephone to a pregnant woman, insulted her and threatened her that he would kill her if she did not quit with his lover", the official Russian daily "Rossijskaya Gazeta" is citing the words of Elena Pimonenko, a senior assistant of Krasnoyarsk prosecutor.
Nevertheless, "the long psychologically damaging situation that was caused by systematic illegal and amoral behavior of the director" (says the General Prosecutor office statement in Krasnoyarsk) did not prevented the accused from wiping out tracks and scrupulously hide the body of the dead man.
The Russian mass media report on regular basis about murder in temporary insanity that was called in the West as "homosexual panic". Those who killed gays due to homosexual panic in Russia prove themselves innocent saying that they were being sexually molested and also were personally injured by alleged hints on their homosexuality. NB: Many countries have adopted the legislation that says it is illegal to be justified by being in gay-panic condition. The New Zealand is the latest country that has amended its legislation in such way.
The terms of imprisonment for criminals who murdered somebody in gay-panic condition in Russia have never been severe. In 2012 a 70-year old pensioner from Tambov was sentenced to 7 years in jail for murder of his 83-year old acquaintance. In February 2012 a citizen of Tula stabbed a man for molesting and got only 8 years in prison (minimum punishment for murder under the article 105 of the Russian Criminal Code). The sentence given in Samara in 2010 in similar case as human rights watch dogs reported was unprecedentedly light - 5 and a half years in colony for murder of a gay who "had been molesting" the accused near one of the city's gay clubs. And the last decision of Krasnoyarsk court is just unbelievable - only 14 months of deprivation of liberty and the fine of 350 000 rubles. The local prosecutor's office is satisfied with this judgment and does not want to appeal.
